Bachelor of Science in Criminology, Cavite State University, Indang, Cavite. June 2019, Adviser: Dr. Marissa C. Lontoc. The main objective of the study to assess the process of the Katarunang Pambarangay in handling dispute through mediation, conciliation, and arbitration. Specifically, Specifically, it aimed to: (l) determine how does the barangay handles disputes; (2) determine the problems encountered by the Katarungang Pambarangay implementers; (3) determine the proposed solution of the implementers on the problems encountered during dispute resolution. The study was conducted from August 2018 to May 2019 in the selected Barangays of General Trias, Cavite. Participants of the study were mediators, conciliators and arbitrators who were selected through purposive sampling technique which an adopted interview guide was used as research instrument. The first set of questionnaires served as the basis to formulate another set of questions. Descriptive research method was used in this study. The participants were composed of forty-five (45) Mediators, forty-five (45) Conciliators and forty-five (45) Arbitration from the selected barangay in City of General Trias, Cavite. As to the process of the dispute resolution of the katarungang pambarangay in selected barangay in City of General Trias, Cavite. The results show that majority of the participants was knowledgeable about the process in handling dispute through mediation, conciliation and arbitration and least of the participants are lacking for the knowledge about the actual process set by the law because in the results, the law indicates the actual process being practiced by the implementers. As to the problems encountered by participants, different barangays in General Trias, Cavite experienced problem on lack of competent implementers and personnel to implement the Katarungang Pambarangay law. Lacking in presentation of evidence or insufficiency of witnesses are the common problem in conciliation process encountered by the katarungang pambarangay in resolving disputes and changing in minds are the common problem katarungang pambarangay encountered during the process of arbitration in resolving disputes. As for possible solutions of the implementers, majority in the mediation stated that they will hear the case peacefully to avoid fights in either party. This solution seems to be effective in selected barangay in resolving disputes. On the part of the conciliation, some stated that no problem encountered, no proposed solution but, the common problem they encountered is that they will pursue the complainant to present evidence and witnesses for the proper hearing of the case. In the arbitration level, whenever a party changes their mind, they will give pieces of advice and explain the possible things to happen when the case is in the court level. The implementer will tell the disputant that the time, effort and money needed in the case when it is in the court level. Therefore, Local Government Unit of the 6th District of Cavite and the Municipal Local Government Operation Officer or Punong Barangays are suggested to conduct seminars, trainings and workshop to train the barangay justice implementers on the structures, procedures and application of the Katarungang Pambarangay Laws which covered the Basic Principles and Proceedings of the Katarungang Pambarangay. Through this program, these administrators ofjustice at the barangay-level are provided with increased procedural and technical skills and knowledge in implementing the Katarungang Pambarangay. Cavite State University may use the result of this study as a basis for an extension project. | |
